Version applicable from 01 May 2025 The terms and conditions of use („Terms of Use”) represent an agreement between you as a user („User”) and Merak Advertising SRL („Company”), having its registered office in Târgoviște, str. Lt. Stancu Ion, no. 21, Dâmbovița county, for any and all of the services provided on the website. https://theelements.ro. The use of the site requires an internet connection for your device and an Android operating system no older than version 10.1 or iOS no older than version 16.1. By installing, accessing or using the site, you agree to the Terms and Conditions of Use detailed in this document. The site is intended exclusively for persons who have reached the age of 16 at the time of its access. By checking the appropriate section on the site, the User confirms that he is 16 years old. The Company reserves the right to request proof from Users that they have reached the age of 16 and to close a User's account if there is a suspicion that he is not of the age allowed to use the site. If you are between 16 and 18 years old and your parent or guardian does not agree to the Terms of Use of the site, you should stop using it and request the Company to delete the account created.

I. General conditions of use

1.1. The General Terms of Use apply to all interactions between the User and the Company through the website, including updates, unless they contain their own terms and conditions. 1.2. Use is conditional on creating a user account and updating existing versions. To create a user account, the following data will be requested: full name, email address, password. The data can be modified or optionally completed later in the existing sections of the site. 1.3. By fully completing the name, the User understands and accepts that the Company may request proof of identity. 1.4. The User is fully and cumulatively responsible for all legal obligations regarding the use of the site, meaning that the User is solely responsible for the use of the devices and services accessible through it. 1.5. Mobile data traffic costs, as well as any other direct, indirect or any other circumstantial costs, are the responsibility of the User for all interactions with the site. 1.6. In all cases where The Elements Spa location location functionalities are used, the location and identification data used will be those transmitted by the User's device, and the use of these functions includes the User's consent to the use of the transmitted data. 1.7. The Company reserves the right to update the Terms and Conditions of Use at any time. The User may request the closure of the account and the deletion of all personal data by email to office@theelements.ro. 1.8. The way in which personal data is collected and/or used is detailed in the Privacy Policy. 1.9. The user can opt-in to receive marketing notifications, offers or promotions via email or push notification messages. Preferences can be modified throughout the period of use of the site.

II. Placing orders on the site

2.1. The purpose of the order placement service through the site is to facilitate Users in placing an order. 2.2. Payment for the order can be made by bank card or cash, upon delivery or pick-up. 2.3. The customer understands and accepts that cash payments may be limited by legislative provisions in force in Romania. 2.4. The Company and/or the Operators use third-party providers for secure storage of payment information and payment processing. 2.5. The user guarantees that he has the necessary financial means and has the right to place the order. 2.6. Orders can be picked up in person or delivered. Delivery costs will be communicated before the order is completed. 2.7. Products can be ordered subject to availability. The company may refuse the order without justification. 2.8. Product and packaging images are for informational purposes only. 2.9. To calculate the cost of shipping, it may be necessary to activate location services. 2.10. Pressing the "Confirm" button authorizes the processing of the order. 2.11. Payment incidents will be treated as a priority, and additional information may be requested. 2.12. The user is advised to contact the bank for clarification regarding transactions. 2.13. The issuing bank can provide information about pending debits. 2.14. The right of withdrawal can be exercised until the order is confirmed. 2.15. Refund requests will be sent to office@theelements.ro.

III. Limitations of liability

3.1. The site may be inappropriate or unavailable outside Romania. 3.2. The terms are governed by Romanian law, and the competent courts are those of Romania. 3.3. In the case of use on iOS, Apple may be a third party beneficiary under its own terms. 3.4. The clauses are separable, and the invalidation of one does not affect the rest. 3.5. Failure to exercise a right does not amount to waiving it.
